1. Introduction
Vastgoedexperts, whose registered office is at Langvoort 17, 2430 Laakdal, Belgium, and which is registered with the Crossroads Bank for Enterprises under company number 0667.567.856, attaches great importance to the secure, transparent and confidential collection and processing of your personal data. In particular, we wish to protect the data of our customers, subcontractors and suppliers, among others, against loss, leaks, errors, unauthorised access or unlawful processing. This data protection notice is intended to inform you about the collection and processing of your personal data. We ask you to read this data protection notice carefully, as it contains essential information about how your personal data is processed and for what purpose. By providing your personal data, you explicitly declare that you have read this data protection notice and you explicitly consent to it and to the processing itself.

This data protection notice covers all the services we provide and, more generally, all the activities we carry out.
3. The controller and his commitments
Realty Experts, whose registered office is at Langvoort 17, 2430 Laakdal, Belgium, and whose company number is 0667.567.856, is responsible for processing your personal data. When collecting and processing your personal data, we comply with Belgian regulations on the protection of personal data, as well as the General Data Protection Regulation (»GDPR«) as of its entry into force on 25 May 2018.
4. Personal data
Depending on your activities and your relationship with our company, you will provide us with the following personal data: your identity and contact details (name, title, address, e-mail address, telephone number and mobile telephone number). We remind you that you are responsible for all the data you provide and that we rely on its accuracy. If your details are no longer up to date, please inform us immediately. You are not obliged to disclose your personal data, but you understand that the provision of certain services or cooperation will be impossible if you do not consent to their collection and processing.
5. Purposes of processing and legal basis
5.1. Customer data
As part of our services and activities, we collect and process the identity and contact data of our customers, their staff, employees, nominees and other relevant contacts. The purposes of this processing are the performance of contracts with our customers, customer management, accounting and direct marketing activities such as the sending of promotional or commercial information. The legal bases are the performance of the contract, compliance with legal and regulatory obligations (such as, for example, the 30bis declaration of works) and/or our legitimate interest.
5.2 Information on suppliers and subcontractors
We collect and process the identity and contact details of our suppliers and sub-contractors, as well as their potential sub-contractor(s), staff, employees, nominees and other relevant contacts. The purposes of this processing are the performance of this agreement, the management of suppliers/subcontractors, accounting and direct marketing activities such as the sending of promotional or commercial information. The legal bases are the performance of the agreement, compliance with legal and regulatory obligations (such as, for example, mandatory electronic attendance recording, 30bis declaration of works, attendance list or other public procurement obligations, etc.) and/or our legitimate interest (such as for direct marketing). For direct marketing activities by email (such as a newsletter or invitation to events), consent is always requested and can be withdrawn at any time.
5.3. Personnel data
We process our employees' personal data as part of our personnel management and payroll administration. Given its specific nature, this processing is regulated more fully in an employee data protection policy.
5.4. Other information
In addition to customer, supplier/subcontractor and staff data, we also process personal data of other persons, such as potential new customers/prospects, useful contacts within our industry, network contacts, expert contacts, etc. The purposes of this processing are in the interests of our operations, direct marketing and public relations. The legal basis is our legitimate interest or, in certain cases, the performance of a contract.
6. Duration of the transformation
We will retain and process personal data for as long as is necessary for the purposes of the processing and the relationship (contractual or non-contractual) that we have with you. Customer and supplier or subcontractor data will in any event be deleted from our systems after a period of one month following the end of the agreement or project, except in the case of personal data which we are required to retain for a longer period on the basis of specific legislation or in the event of ongoing litigation for which the personal data is still required.
7. The rights
In accordance with and pursuant to Belgian legislation on the protection of privacy and the provisions of the General Data Protection Regulation, we inform you that you have the following rights:
- Right of access and inspection: you have the right to access free of charge the data we hold about you and to know what it is used for.
- Right of rectification: you have the right to obtain rectification (correction) of your incorrect personal data, as well as to complete incomplete personal data.
- Right to erasure or restriction of data: you have the right to ask us to erase or restrict the processing of your personal data in the circumstances and under the conditions set out in the General Data Protection Regulation. We may refuse to erase or restrict personal data that is necessary for compliance with a legal obligation, the performance of a contract or our legitimate interest, and for as long as the data is necessary for the purposes for which it was collected.
- Right to data portability: you have the right to obtain the personal data you have provided to us in a structured, manageable and machine-readable format. You have the right to transfer this data to another data controller.
- Right to object: you have the right to object to the processing of your personal data on serious and legitimate grounds. However, please note that you may not object to the processing of personal data necessary for the fulfilment of a legal obligation, the performance of a contract or our legitimate interest, as long as such data is necessary for the purposes for which it was collected.
- Right to withdraw consent: if the processing of personal data is based on prior consent, you have the right to withdraw that consent. This personal data will then only be processed if we have another legal basis for doing so.
- Automatic decisions and profiling: we confirm that the processing of personal data does not involve profiling and that you will not be subject to fully automated decisions.

8. Transfer to third parties
Certain personal data collected by us will be transmitted to and possibly processed by third-party service providers, such as our IT supplier, our accountant, our auditor, as well as by public authorities (for example, in the case of the 30bis works declaration, electronic attendance registration or competitive tendering for public contracts).
One or more of the above-mentioned third parties may be located outside the European Economic Area («EEA»). However, personal data will only be transferred to third countries offering an adequate level of protection.
The employees, managers and/or representatives of the service providers or institutions mentioned above and the specialist service providers appointed by them respect the confidential nature of your personal data and may only use this data for the purposes for which it was provided. If necessary, your personal data may be passed on to other third parties. This may be the case, for example, if we are reorganised in whole or in part, if our activities are transferred or if we are declared bankrupt. It is also possible that personal data may have to be disclosed by virtue of a court order or to comply with a certain legal obligation. In this case, we will make reasonable efforts to inform you in advance of any such disclosure to other third parties. 9. Technical and organisational measures
We take the necessary technical and organisational measures to process your personal data with an adequate level of security and to protect it against destruction, loss, falsification, modification, unauthorised access or incorrect notification to third parties, as well as against any other unauthorised processing of such data.
Under no circumstances can «Profile Advertising Agency» as «Haylo» be held responsible for any direct or indirect damage resulting from the erroneous or illegal use of personal data by a third party.
10. Third party access
For the purposes of processing your personal data, we grant access to your personal data to our employees, partners and appointees. We ensure a similar level of protection by imposing contractual obligations on these employees, associates and appointees similar to this data protection notice.
